Agreement to Terms

By accessing or using mtntekadventure.com (the "Site") or purchasing products from MTNtek Adventure LLC ("MTNtek," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or purchase our products.

Products and Pricing

All products are subject to availability. We reserve the right to discontinue any product at any time without notice.

Prices are listed in U.S. dollars and are subject to change without notice. We make every effort to display accurate pricing, but errors may occur. If we discover a pricing error after you have placed an order, we will notify you and give you the option to confirm or cancel the order at the correct price.

Product images are for illustration purposes and may differ slightly from the actual product due to photography, display settings, and manufacturing variations.

Orders and Payment

By placing an order, you represent that you are at least 18 years old and that all information you provide is accurate and complete.

We accept payment through the methods displayed at checkout, processed securely through Shopify Payments. You agree to pay all charges associated with your order, including applicable taxes.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, suspected fraud, or errors in pricing or product information. If we cancel your order after payment has been processed, we will issue a full refund.

Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms by reference. Estimated delivery times are not guaranteed.

Risk of loss and title for items purchased from us pass to you upon delivery to the carrier.

Returns and Refunds

Product warranties are governed by our Warranty Policy, which is incorporated into these Terms by reference.

Intellectual Property

All content on our Site — including but not limited to text, images, graphics, logos, product designs, and software — is the property of MTNtek Adventure LLC or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on our Site without our prior written permission.

"MTNtek," "MTNtek Adventure" and the MTNtek logo are trademarks of MTNtek Adventure, LLC.

User Conduct

When using our Site, you agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Site or its systems
  • Interfere with or disrupt the Site's functionality
  • Submit false or misleading information
  • Use automated systems (bots, scrapers) to access the Site without our permission
  • Infringe upon the intellectual property rights of MTNtek or any third party

Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT AS SPECIFICALLY STATED IN OUR WARRANTY POLICY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MTNTEK ADVENTURE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF OUR PRODUCTS, INCLUDING BUT NOT LIMITED TO:

  • DAMAGE TO BIKES, VEHICLES, OR OTHER PROPERTY
  • PERSONAL INJURY
  • LOSS OF DATA OR PROFITS
  • BUSINESS INTERRUPTION

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Assumption of Risk

Bike racks are used to transport bicycles on motor vehicles at highway speeds. By purchasing and using an MTNtek product, you acknowledge that:

  • Proper installation per the provided assembly guide is your responsibility
  • The rack must be installed into a 2-inch Class III or higher receiver hitch using the included hardware
  • You are responsible for confirming your vehicle's tongue weight capacity is sufficient for the combined weight of the rack and loaded bikes before use
  • Regular inspection and maintenance of the rack and all connections is required before each use — verify that all bolts, straps, latches, and locking pins are secure and undamaged before driving
  • You are responsible for ensuring bikes are properly secured and that the included safety pin and/or anti-rattle hitch clamp are installed before driving
  • A loaded bike rack may affect vehicle handling, turning radius, ground clearance, and rear overhang — exercise additional caution when driving, parking, and reversing
  • You are responsible for compliance with all applicable laws and regulations, including license plate visibility and taillight obstruction laws
  • Use of the product carries inherent risk, and you assume that risk

Indemnification

You agree to indemnify and hold harmless MTNtek Adventure LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Site, purchase or use of our products, or violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of our products shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered in Cache County, Utah, in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class arbitration.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
